Smart Tech Insurance is not responsible for data loss resulting from repairs, diagnostics, software installation, firmware updates, or hardware replacement.
14.IT Asset Disposition (ITAD)
Customers utilizing Smart Tech Insurance’s IT Asset Disposition services represent that they have legal authority to transfer ownership of submitted equipment.
Where requested or contractually required, Smart Tech Insurance utilizes recognized data sanitization methods, including BitRaser, prior to resale, recycling, or disposal.
Ownership transfers only in accordance with the applicable purchase agreement or written contract.
15.Intellectual Property
All Website content—including text, graphics, logos, photographs, videos, icons, software, downloadable materials, and custom designs—is owned by or licensed to Smart Tech Insurance and protected by intellectual property laws.

Before initiating legal proceedings, the parties agree to make a good-faith effort to resolve any dispute through direct discussions.
If a dispute cannot be resolved informally, any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in the State of Florida.
Each party consents to the personal jurisdiction and venue of those courts.
Nothing in this section limits Smart Tech Insurance’s right to seek injunctive or equitable relief to protect its intellectual property, confidential information, or security interests.
28.Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.
29.Waiver
No failure or delay by Smart Tech Insurance in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy.
Any waiver must be in writing and signed by an authorized representative of Smart Tech Insurance.
30.Assignment
You may not assign or transfer your rights or obligations under these Terms without Smart Tech Insurance’s prior written consent.
Smart Tech Insurance may assign these Terms in connection with:

These Terms shall bind and benefit the parties and their permitted successors and assigns.
31.Entire Agreement
These Terms, together with the Smart Tech Insurance Privacy Policy, Cookie Policy, Information Security Policy, Student Data Privacy Statement, and any additional policies expressly incorporated by reference, constitute the entire agreement between you and Smart Tech Insurance regarding your use of the Website.
These Terms do not modify or replace any separate written agreement governing purchases, repair services, warranties, IT Asset Disposition (ITAD), membership plans, or other commercial transactions.
